Conditions générales

This document constitutes a Contract whereby the provision of services by SAFKO LAKO S.A.S., to its TOMADORES will be regulated. 2.1 ACCEPTANCE OF TERMS AND CONDITIONS BY THE TOMATOR. By accepting these Terms and Conditions it is presumed that THE TOMADOR is aware of the level of risk involved in the activities offered by MONTANA GLAMPING AND MONTANA GUESTHOUSE and that they are freely accepted by THE TOMADOR, who assumes full responsibility for the damages caused to itself or to third parties during the execution of said activities. 2.2 REQUIREMENTS TO BE FULFILLED BY THE SERVICE TAKER. TOMADORES who are not over 18 years of age must be accompanied by their parents, who will sign all the documents in their name or by a responsible adult duly authorized in writing by the person in charge. Likewise, the TOMADORES must present the licenses / courses / certifications / permits / medical declarations or any suitable document that certifies their experience, aptitude and ability to take and participate in the services acquired from MONTANA GLAMPING AND MONTANA GUESTHOUSE according to the table included at the end of these Terms and Conditions. However, MONTANA GLAMPING AND MONTANA GUESTHOUSE will require the TOMADOR to submit information through the medical form that the TOMADOR completes before staying and of certain documents to prove their medical condition and ability to access the services, it will be up to the TOMADOR to submit to MONTANA GLAMPING AND MONTANA GUESTHOUSE any additional information that in its opinion is relevant to prove the fullness of its capabilities and any relevant medical condition. MONTANA GLAMPING AND MONTANA GUESTHOUSE declares that the only source of information to which it will have access will be that provided exclusively by the TOMADORES, which will presume truthful, complete and timely at all times. The lack of truthful, complete and timely information will be considered as grounds for exclusion of liability of SAFKO LAKO S.A.S. 2.3. SERVICES OFFERED THROUGH THE PAGE. To access any of the above services, EL TOMADOR must request MONTANA GLAMPING AND MONTANA GUESTHOUSE the service of their choice by completing and sending the service request formats established by MONTANA GLAMPING AND MONTANA GUESTHOUSE on the web pages, through email, phone call, or any means that allows you to meet MONTANA GLAMPING AND MONTANA GUESTHOUSE the trip desired by the TOMADOR. For the purposes of this document, EL TOMADOR and MONTANA GLAMPING AND MONTANA GUESTHOUSE will understand that there are two kinds of offers:
STANDARD OFFERS: These are the offers offered by MONTANA GLAMPING AND MONTANA GUESTHOUSE through its web pages and on which THE TOMADOR accepts the content and conditions expressly established therein.
PERSONALIZED OFFERS - CUSTOMIZED ACCOMMODATION: These are the offers that are particularly designed by MONTANA GLAMPING and MONTANA GUESTHOUSE for a specific interested TOMADOR, and that exceed, modify or complement the standard offers.

2.4. RESERVATION OF SERVICES. To make a reservation for any service, the TOMADOR must fill out and send the “RESERVATION FORM” or other “FORMATS” established by MONTANA GLAMPING AND MONTANA GUESTHOUSE on its website, which, for all legal purposes, will be considered service orders in favor of MONTANA GLAMPING AND MONTANA GUESTHOUSE. Only the reservation of the service by the TOMADOR will be understood as perfected, once MONTANA GLAMPING AND MONTANA GUESTHOUSE accept the service request sent by THE TOMADOR. MONTANA GLAMPING AND MONTANA GUESTHOUSE reserves the right not to accept service orders whose TOMADORES do not meet the requirements demanded by the company or whenever the service requested by THE TOMADOR exceeds in any way the capabilities of MONTANA GLAMPING AND MONTANA GUESTHOUSE. 2.5.1 CANCELLATION OR RE-PLANNING OF THE SERVICE BY THE TOMATOR. In case of any modification or cancellation of the reservation by the TOMADOR, MONTANA GLAMPING AND MONTANA GUESTHOUSE will apply the cancellation rules defined for each of the services, which will be included in the standard or adjusted offer. In case they do not define the cancellation conditions in the offers, the following rules will be applied subsidiarily: I) By cancellation of the requested service with a period of EIGHT (8) or more calendar days in advance of the stipulated start date, it will not be No penalty will be charged to the customer. II) If the customer cancels the service between the SEVEN (7) days or less prior to the start date of the service, he will lose one hundred percent (100%) of the paid value of the service; III) If the customer cancels the service during their stay, they will lose one hundred percent (100%) of the value paid. MONTANA GLAMPING AND MONTANA GUESTHOUSE will not be obliged to reimburse the TOMADOR any amount if, for reasons beyond MONTANA GLAMPING AND MONTANA GUESTHOUSE, the TOMADOR does not show up on the day of his reservation or arrives later without prior notice. Notwithstanding the foregoing, MONTANA GLAMPING AND MONTANA GUESTHOUSE reserves the option to make the refunds it considers, in case the cancellation of the trip by the TOMADOR is due to personal reasons or force majeure. If the TOMADOR cancels the service with EIGHT (8) or more days in advance, and wishes to postpone the date of the service, he may use the previous reservation for another service at any time, without losing the deposit. The new reservation will be subject to availability and conditions given by MONTANA GLAMPING AND MONTANA GUESTHOUSE and no refund will be made.
2.5.2. CANCELLATION AND / OR MODIFICATIONS OF THE TRIPS BY MONTANA GLAMPING AND MONTANA GUESTHOUSE BEFORE THE START OF THE SAME. In a situation that is considered as force majeure and / or fortuitous event or made by a third party, MONTANA GLAMPING AND MONTANA GUESTHOUSE may cancel any of the reservations, and the TOMOR must be reimbursed ONE HUNDRED PERCENT (100%) of the amount paid. MONTANA GLAMPING AND MONTANA GUESTHOUSE will not be liable for any expenses incurred by the TOMADOR. MONTANA GLAMPING AND MONTANA GUESTHOUSE may modify in any way the offers published on the page, without prior notice, in the events in which situations beyond its control arise that require it, such as, sudden alteration of the state of the roads, increased costs, weather conditions, and other external factors that could limit the services offered. You can also modify the offer in any way for security situations that warrant it, prior to the start of the service execution or during the execution of the service. This will not constitute a breach by MONTANA GLAMPING AND MONTANA GUESTHOUSE. In any case, MONTANA GLAMPING AND MONTANA GUESTHOUSE guarantees that the new conditions will maintain the standards initially offered. 2.5.3. CANCELLATION AND / OR MODIFICATIONS OF THE CONDITIONS OF THE TRIPS BY MONTANA GLAMPING AND MONTANA GUESTHOUSE AFTER INITIATED. MONTANA GLAMPING AND MONTANA GUESTHOUSE may cancel the service after its start and cause the TOMADOR to withdraw if it does not comply with the safety, use and behavior standards required in the facilities of MONTANA GLAMPING AND MONTANA GUESTHOUSE, or at any time that the TOMADOR causes physical or psychological aggressions to the other guests or to third parties, or when his way of behaving is dangerous, reckless and / or represents a risk for him or the persons accompanying him. MONTANA GLAMPING AND MONTANA GUESTHOUSE may modify any of the conditions of execution of the contracted services whenever there are situations beyond its control that require it; including but not limited to: acts of civil disorder; including war, blockades, insurrections, riots, mass protests, and actions of military forces related to or in response to some act of civil disorder, acts, or absence of acts, of the Government and of the Legislative and Judicial branches including laws, orders, regulations, decrees, sentences, legal actions, regulations, renewal or confirmation of permits and licenses, which are carried out either by the Government or any Competent Authority on equipment rental activities or high-risk activities, epidemics, landslides , hurricanes, floods, avalanches, lightning, earthquakes, fire, disaster in land, air transport, and sudden alteration of road conditions, climatic conditions and other external factors that could limit the services offered; without for that reason non-compliance by MONTANA GLAMPING AND MONTANA GUESTHOUSE. In any case, MONTANA GLAMPING AND MONTANA GUESTHOUSE guarantees that the new conditions will keep the initially offered standards to the best of their ability and if it becomes necessary to cancel the trip MONTANA GLAMPING AND MONTANA GUESTHOUSE is not obligated to reimburse the payment of the service.2.6. PRICE, DEPOSIT AND FINAL PAYMENT. Once the purchase request has been completed and sent by the TOMADOR and accepted by MONTANA GLAMPING AND MONTANA GUESTHOUSE, the TOMADOR will be obliged to pay the agreed price for the particular service selected or the price sent by MONTANA GLAMPING AND MONTANA GUESTHOUSE if it is a trip tailored to the client, with a tight offer. In the case of adjusted offers, the price must be paid within ten (10) days following the acceptance by MONTANA GLAMPING AND MONTANA GUESTHOUSE and the sending of the price confirmation, by means of a minimum deposit required by MONTANA GLAMPING AND MONTANA GUESTHOUSE that will vary for each particular service. The percentage of the payment that constitutes the deposit, entitles the TOMADOR to respect its quota in the service and will be taken into account as an advance payment of the same. The balance payment must be paid in one or several installments according to the conditions defined in the selected offer. MONTANA GLAMPING AND MONTANA GUESTHOUSE will reserve the right to cancel the reservation and charge a fine equivalent to the deposit, in the event that the TOMADOR does not make one or more payments in a timely manner. In the case of standard offers, the prices shown on the page are reference, so they may vary in case MONTANA GLAMPING AND MONTANA GUESTHOUSE so require in order to meet the needs of the TOMADOR, all of which will be done with prior notice. In all cases raised, the total payment of the SERVICE must always be canceled before starting the TRIP, unless MONTANA GLAMPING AND MONTANA GUESTHOUSE has expressly agreed a different period with the TOMADOR. 2.6.1. INCLUSIONS IN SERVICES PRICES. The price paid by EL TOMADOR to MONTANA GLAMPING AND MONTANA GUESTHOUSE by virtue of the selected services, will include only and exclusively those activities expressly related in the standard and / or adjusted offer, effectively accepted by MONTANA GLAMPING AND MONTANA GUESTHOUSE, as well as all those services Complementary that are reasonably required for their effective execution under the service standards of MONTANA GLAMPING AND MONTANA GUESTHOUSE. 2.7.1 PRICE EXCLUSIONS. Those aspects that are not expressly included in the standard offer that appears in what the service includes on the website or that adjusted offer that is accepted by MONTANA GLAMPING AND MONTANA GUESTHOUSE and that is included in the price of the services will not be included sent to the TOMADOR. Nor will it include personal implements, personal travel expenses, traffic fines, rental of vehicles and / or equipment other than those provided during the trip, among others. 2.7.2. LUGGAGE, CARS AND OTHER PERSONAL OBJECTS. MONTANA GLAMPING AND MONTANA GUESTHOUSE will not be liable at any time for the loss of luggage, personal objects inside vehicles, damage or loss of vehicles or loss of any personal object of the TOMADOR and / or his companion if it is the case inside or outside the facilities of MONTANA GLAMPING AND MONTANA GUESTHOUSE. It is recommended to establish a policy to insure luggage, cars or other items. PROPERTY OF MULTIMEDIA MATERIAL. MONTANA GLAMPING AND MONTANA GUESTHOUSE may use such material for any purpose, at its discretion, without any limitation and without the obligation to have a permit from the TOMADORES that appear in the material. 2.8. WAY TO PAY. Payments made to MONTANA GLAMPING AND MONTANA GUESTHOUSE must be made through the means of payment enabled on the website or through the means specified by MONTANA GLAMPING AND MONTANA GUESTHOUSE to the TOMADOR. 2.9. VALID DOCUMENTATION REQUIRED. MONTANA GLAMPING AND MONTANA GUESTHOUSE assumes that EL TOMADOR is aware and aware of the fact that to travel in Colombia and taking into account the requirements of MONTANA GLAMPING AND MONTANA GUESTHOUSE, it must have the required documents, such as visa, vaccines, certificates, between others. RESPONSIBILITY. MONTANA GLAMPING AND MONTANA GUESTHOUSE will be responsible for providing the services offered on its website or those agreed between it and the TOMADOR, limiting its scope to that published on its Internet pages at the time of completion. MONTANA GLAMPING AND MONTANA GUESTHOUSE will not be liable in the event that these conditions must be modified without prior notice by MONTANA GLAMPING AND MONTANA GUESTHOUSE in case of circumstances of force majeure or fortuitous event. THE TOMADOR will be liable to MONTANA GLAMPING AND MONTANA GUESTHOUSE for the payment of the price of the service that he chooses, as well as for all the damages caused during the same to third parties, those that may affect his good name and commercial reputation, for the damages and injuries bodily or death suffered during the service whenever they result from efficient causes beyond MONTANA GLAMPING AND MONTANA GUESTHOUSE, for those traffic accidents and damages to third parties that occurred as a result of the services taken as long as they do not come from force majeure, fortuitous case or fault of the victim. THE TOMADOR of the service will be liable to MONTANA GLAMPING AND MONTANA GUESTHOUSE for any damage that he or his companion causes in MONTANA GLAMPING AND MONTANA GUESTHOUSE to equipment, rooms, outdoor spaces, damage to other guests, employer or third parties. THE TOMADOR accepts that he will respond exclusively for the payment of all damages and / or damages caused to himself, his relatives, his heirs, third parties and in general to any person during the term and execution of these TERMS AND CONDITIONS, freeing MONTANA GLAMPING AND MONTANA GUESTHOUSE from the duty of vigilance that THE TOMATOR has with its dependents or those responsible for the minor who participates in any of the trips. MONTANA GLAMPING AND MONTANA GUESTHOUSE will not ensure the safety of the TOMADOR, the loss of luggage or any personal effects of the TOMADOR and / or his companions. MONTANA GLAMPING AND MONTANA GUESTHOUSE will only be responsible for those acts derived from intent and / or serious fault. Whenever MONTANA GLAMPING AND MONTANA GUESTHOUSE acts in front of the TOMADOR as a marketer of a service operated by an affiliated third party, he will be responsible to the TOMADOR: (i) to guarantee the existence and provision of the service based on the information previously provided in its website, in accordance with its standards and the information provided to MONTANA GLAMPING AND MONTANA GUESTHOUSE; (ii) to transmit to the TOMADOR, in a clear, concise and complete manner, the relevant information so that it knows the characteristics of the service (s) that must be operated by the third party provider and on which MONTANA GLAMPING And MONTANA GUESTHOUSE presumes its veracity; (iii) Receive and process any complaint or claim that THE TOMADOR submits to the affiliated third party; (iv) to transmit to the TOMADOR, in a clear, concise and complete manner, the relevant information so that he knows the characteristics of the service (s) he wishes to acquire; (v) remain at the disposal of the TOMADOR to address and resolve any doubt or inconvenience that may arise related to the provision of the service and prior to the signing of the contract between the latter and the affiliated third party; (vi) provide permanent support to the TOMADOR, through the appropriate means, providing advice related to the services of the affiliated third parties until the moment of signing the contract; (vii) ensure that the signing of the contract or binding agreement between THE TOMADOR and the affiliated third party is carried out; (viii) guarantee the good condition and operation of the equipment used, such as, but not being understood as the only ones: airplanes, light aircraft, buses, vans, land transport, bicycles, motorcycles, among others. MONTANA GLAMPING AND MONTANA GUESTHOUSE will not be liable for any falsehood or inaccuracy in the information provided by the third party provider or for any incident of any kind that occurs under the contract or that is directly or indirectly related to the execution thereof. If MONTANA GLAMPING AND MONTANA GUESTHOUSE should accompany the TOMADOR to any of the services provided by the third party provider, this will not be taken as an assumption of responsibility under any circumstances. Based on the foregoing, it is understood that THE TOMADOR already accepts the waiver that MONTANA GLAMPING AND MONTANA GUESTHOUSE expressly makes in the terms described above. EL TOMADOR will be responsible for informing MONTANA GLAMPING AND MONTANA GUESTHOUSE in a timely and written manner of any incident, complaint or suggestion that arises around the third party provider. In the event that MONTANA GLAMPING AND MONTANA GUESTHOUSE acts as a commercial agent for third-party service providers As a commercial agent of third party products that provide travel and adventure travel services, he will be responsible to the TOMADOR: (i) to inform about the existence and characteristics of the service (s) offered by the third-party provider based in the information previously provided by the latter to MONTANA GLAMPING YMONTANA GUESTHOUSE and about which MONTANA GLAMPING AND MONTANA GUESTHOUSE presumes its truthfulness; (ii) To contact the third party provider and the interested TOMADOR; (iii) to transmit to the TOMADOR, in a clear, concise and complete manner, the additional information that the TOMADOR may require about the service provided by the third party provider; (iii) to keep the TOMADOR and the third party informed of any situation that could affect the signing of the contract or its correct execution; (iv) to resolve to the TOMADOR any doubt that with his knowledge could solve in relation to the products of third party suppliers; (v) provide collaboration to carry out the signing of the contract or binding agreement between THE TOMADOR and the third party provider. 2.11. RISK. EL TOMADOR is aware of the risks and consequences of participating in the activities offered by MONTANA GLAMPING AND MONTANA GUESTHOUSE in its facilities and the risks involved in lodging at MONTANA GLAMPING AND MONTANA GUESTHOUSE, an outdoor place. That in addition to the existing risks, some of the activities that will be exercised during the stay can be high risk, which includes certain risks to suffer damage without being limited to: physical, mental or cognitive damage caused by adverse weather conditions, development of the activity offered at great heights, traffic rules, heavy traffic or not, conditions of the routes or roads that need to be taken, among others. Likewise, there may be risks arising from the remote location where the service is executed and that prevent timely medical assistance and other benefits that are accessed in populated places, as well as situations of insecurity, theft, theft, among others. In the trips of MONTANA GLAMPING AND MONTANA GUESTHOUSE which includes the hiring by MONTANA GLAMPING AND MONTANA GUESTHOUSE of air or land transport, in which MONTANA GLAMPING AND MONTANA GUESTHOUSE acts as a simple intermediary between the TOMADOR and the THIRD provides the service, the TOMADOR when sending the reservation request understands and accepts the risks to which it is exposed and understands that MONTANA GLAMPING Y MONTANA GUESTHOUSE will not be responsible for any damage caused to the TOMADOR, derived from, in others, accident, theft or any other incident that occurs during the provision of such services. 2.12 CHECK IN AND CHECK OUT. 3.1. At MONTANA GLAMPING AND MONTANA GUESTHOUSE, we enforce the requirements of Decree 4000 of 2004 Concerning Foreigners Control. 3.2. We are subject to Law 1335 of 2009 Anti-Tobacco; and we commit ourselves to the non-discrimination and exclusion of vulnerable populations and the special requirements for the protection of personal data of minors (children and adolescents), and adults, as explained in point 2 of this document, as as governed by law.
